Terms of Use

Welcome to Piksey. These terms are an agreement between you and Lonz LLC ("Piksey", "we", "us"), which runs the Piksey app. By creating an account or using Piksey, you agree to these terms and to our Privacy Policy. If you don't agree, please don't use Piksey.
An unofficial fan app
Piksey is made by fans, for fans. It isn't affiliated with, endorsed by or sponsored by The Walt Disney Company or any of its parks. Park, attraction, restaurant and shop names are used only to say where your memories happened. All trademarks belong to their owners.
Who can use Piksey
You must be at least 13 years old. If you're under 18 (or the age of majority where you live), you need a parent or guardian's permission, and they agree to these terms for you. You can't use Piksey if we've removed you before, or if the law where you live doesn't allow it.
Your account
Keep your sign-in email secure, because anyone with access to it can sign in as you. Choose a username that isn't someone else's name or brand and isn't offensive. You're responsible for what happens on your account. Tell us at hello@piksey.app if you think someone else is using it.
What you post
Your memories, photos, clips, captions and comments stay yours. So that Piksey can work, you give us a worldwide, non-exclusive, royalty-free license to store, copy, resize, display and share them with the people you choose in the app, including on share cards you create. This license ends when you delete the content or your account, except for copies in backups for a short time, or where someone has already shared a card you made.
Only post things you have the right to post, and don't post other people's private information. By tagging a friend, you're saying they were really there with you.
Community rules
We don't tolerate objectionable content or abusive people. Don't post, send or do anything that:
- is sexual, nude or sexually suggestive, or sexualizes anyone under 18 in any way;
- harasses, bullies, threatens, stalks or shames anyone;
- promotes hate or violence against people based on who they are;
- shows or encourages violence, self-harm, or dangerous or illegal activity;
- is spam, a scam or misleading, or pretends to be someone else;
- infringes someone else's copyright, trademark, privacy or other rights;
- tries to cheat the game, for example by faking locations, using bots, or making extra accounts for XP or stamps;
- tries to break, overload, scrape or get around the security of Piksey.
You can report any memory, comment or person from its menu, and block anyone at any time. We review reports within 24 hours. We may remove content and suspend or remove accounts that break these rules, sometimes without warning. Content reported by several people may be hidden while we review it.
Stamps, XP and the game
Stamps, XP, levels, streaks and leaderboards are just for fun. They have no cash value and can't be bought, sold or transferred. We may change how they work, fix mistakes, or remove points earned by breaking these rules.
Be safe in the parks
Please don't use Piksey while on a ride, crossing a path or anywhere it isn't safe, and always follow park rules and cast member instructions. Place information such as names, lands, wait times, park hours and whether something is open comes from public sources, including ThemeParks.wiki and OpenStreetMap. It may be out of date, so check official sources before planning your day.
Ending things
You can delete your account at any time from Passport → Delete account. We may suspend or end your access if you break these terms, if the law requires it, or if we stop offering Piksey. The parts of these terms that should last, such as the disclaimers and limits below, continue to apply after your account ends.
Disclaimers
We work hard to keep Piksey running well, but it's provided "as is" and "as available". To the extent the law allows, we make no warranties, express or implied, including that Piksey will always be available, error-free or accurate. We aren't responsible for what other people post.
Limits on liability
To the extent the law allows, Piksey and the people who run it won't be liable for any indirect, incidental, special, consequential or punitive damages, or for lost data, profits or goodwill. Our total liability for any claim about Piksey is limited to the greater of the amount you paid us in the past 12 months or 50 US dollars. Some places don't allow these limits, so they may not apply to you.
Disputes
These terms are governed by the laws of the State of Florida and of the United States, without regard to conflict-of-law rules. Any dispute will be handled in the state or federal courts located in Florida, unless the law where you live gives you the right to bring it elsewhere. Please email us first, since most problems can be sorted out quickly.
The App Store
If you got Piksey from Apple's App Store, these terms are between you and us, not Apple. Apple isn't responsible for Piksey or its content, and has no obligation to provide maintenance or support for it. If Piksey fails to meet any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any. To the extent the law allows, Apple has no other warranty obligation for Piksey. We, not Apple, are responsible for handling any claims about Piksey, including product liability claims, claims that it fails to meet legal or regulatory requirements, consumer protection claims, and claims that it infringes someone's intellectual property. You confirm that you aren't located in a country subject to a US government embargo or on a US government list of prohibited or restricted parties. You must also follow any third-party terms that apply when using Piksey. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
Changes
We may update these terms as Piksey grows. If a change matters, we'll tell you in the app before it takes effect. Continuing to use Piksey after that means you accept the new terms.
